By using tagga.ai (the "Service"), you agree to be bound by the following terms and conditions
(the "Terms of Service"). If you are entering into this agreement on behalf of a company or other
legal entity, you represent that you have the authority to bind that entity and its users to these
terms, in which case "you" refers to that entity. If you do not agree with these terms, you must
not use the Service.
tagga.ai reserves the right to update and change these Terms of Service from time to time. Any new
features that augment or enhance the Service shall be subject to the Terms of Service. Continued use
of the Service after any such changes constitutes your consent to the changes. You can review the
most current version of the Terms of Service at any time on this page.
- You must be 16 years or older to use this Service.
- You must be a human. Accounts registered by bots or other automated methods are not permitted.
- You must provide a valid email address and any other information requested to complete signup.
- Your login may only be used by one person. You may create separate logins for as many people as your plan allows.
- You may not create multiple free accounts to bypass plan limits or usage restrictions. Accounts created to circumvent limits may be suspended or removed at our discretion.
- You are responsible for maintaining the security of your account and password. tagga.ai cannot and will not be liable for any loss or damage resulting from your failure to comply with this obligation.
- You are responsible for all content uploaded and activity that occurs under your account, including content uploaded by workspace members and by anyone using upload links you share.
- You may not use the Service for any illegal or unauthorized purpose. You must not, in your use of the Service, violate any laws in your jurisdiction (including but not limited to copyright, trademark, and privacy laws).
- Paid subscriptions are billed and processed by Stripe. By upgrading to a paid plan, you also agree to Stripe's applicable terms.
- Free accounts are not required to provide a credit card.
- An upgrade from the free plan to any paid plan is billed immediately.
- The Service is billed in advance on a monthly or annual basis. If you are not satisfied, you may cancel and request a refund within 30 days of your first payment by emailing [email protected]. After this period, payments are non-refundable: there are no refunds or credits for partial months, downgrades, or unused time on an open account.
- All fees are exclusive of taxes, levies, or duties imposed by taxing authorities; you are responsible for those where applicable.
- Downgrading your plan may cause the loss of features, storage, or capacity of your account. tagga.ai does not accept liability for such loss.
- You are responsible for properly cancelling your subscription. You can cancel at any time from your account settings; an email or phone request alone is not considered cancellation.
- If you cancel before the end of your current paid period, your plan benefits remain active for the time you already paid for, and you will not be charged again.
- When you permanently delete your account, all of your content — photos, videos, documents, tags, collections, and face data — is deleted from the Service. This cannot be recovered once your account is terminated.
- tagga.ai, in its sole discretion, has the right to suspend or terminate your account and refuse any current or future use of the Service for violation of these terms. tagga.ai reserves the right to refuse Service to anyone for any reason at any time.
- tagga.ai reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without notice.
- Prices of all plans are subject to change upon 30 days notice. Notice may be provided at any time by posting the changes to the tagga.ai website or within the Service itself.
- tagga.ai shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
- We claim no intellectual property rights over the content you upload to the Service. Your photos, videos, and documents remain yours.
- We will not use your content for any purpose other than to provide the Service to you — including generating the AI descriptions, tags, embeddings, and search indexes that make your archive searchable. We do not use your content to train generalized AI models.
- If you make a collection, gallery, or item publicly shareable, you allow anyone with the link to view and/or download that content, subject to the protections (password, expiry) you configure.
- You must own or have the necessary rights to all content you upload. You are responsible for ensuring your use of the Service does not infringe the intellectual property, privacy, or publicity rights of any third party.
- tagga.ai does not pre-screen content, but has the right (though not the obligation) to refuse or remove any content available via the Service at its sole discretion.
- The Service automatically analyzes uploaded media using AI — generating descriptions, keywords, detected text, colors, and similar metadata. This processing may involve trusted third-party AI providers acting on our behalf; your content is not used by them to train their models.
- Our face recognition groups photos of the same person together to make them easy to find. To achieve this, a numerical signature of each detected face is generated and stored.
- tagga.ai is designed for managing your own archive — events, studios, agencies, and personal collections. You must not use the platform for surveillance, for creating unauthorized large-scale databases of people, or for any other unlawful purpose. In some jurisdictions, local laws restrict the processing of biometric data; you are responsible for ensuring you have any consent required from the people in your photos.
- Face signatures can be deleted by removing the related person or photos, and are deleted entirely when your account is deleted.
- Gallery links, upload links, and "find my photos" links are created and controlled by you. You are responsible for who you share them with and for configuring appropriate protections (passwords, expiry dates, upload limits).
- Content uploaded by third parties through your upload links becomes part of your archive and your responsibility under these terms.
- Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis.
- Technical support is provided via email, with priority levels according to your plan.
- You understand that tagga.ai uses third-party vendors and hosting partners to provide the hardware, software, networking, storage, and related technology required to run the Service.
- You must not modify, adapt, or hack the Service or falsely imply that another website is associated with the Service or tagga.ai.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from tagga.ai.
- You must not upload, post, host, or transmit unsolicited email or "spam" messages, worms or viruses, or any code of a destructive nature.
- Verbal, physical, or written abuse of any tagga.ai customer, employee, or officer will result in immediate account termination.
- If your bandwidth or storage usage significantly exceeds the average of other customers on your plan, we reserve the right to throttle or disable your account until usage is reduced.
- tagga.ai does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) results obtained from use of the Service — including AI-generated descriptions, tags, and face groupings — will be accurate or reliable, or (iv) any errors in the Service will be corrected.
- You expressly understand and agree that tagga.ai shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the Service.
- To the extent tagga.ai is liable to you for any reason, its liability is limited to the amount you paid for the Service in the preceding 12 months.
- The failure of tagga.ai to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision. These Terms of Service constitute the entire agreement between you and tagga.ai and govern your use of the Service, and are governed by the laws of Brazil.
